Welcome to Teal AI. These Terms of Use ("Terms") govern your access to and use of the Teal AI mobile application, website (tryteal.ai), and related services (collectively, the "Service"). Please read these Terms carefully. By creating an account or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using our Service, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Teal AI provides an interactive audiobook and reading platform. The Service allows users to interact with text via AI, sync reading progress, and upload personal reading materials (including PDFs, URLs, and raw text) for cross-device and cross-session access and AI processing.

3. User Accounts

You must create an account to use the Service. You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User-Uploaded Content and Copyright

a. Your Responsibility: The Service allows you to upload, link, and sync content, including PDFs, raw text, and URLs ("User Content"). You are solely responsible for your User Content. You represent and warrant that you own the User Content or have obtained all necessary licenses, rights, consents, and permissions to upload and process it through the Service.

b. Copyright Infringement: You agree not to upload, sync, or process any material that infringes upon the intellectual property rights, copyrights, trademarks, or privacy rights of any third party. Teal AI assumes no liability for User Content. We act solely as a cloud storage and processing intermediary for the files you choose to upload.

c. License to Teal AI: By uploading User Content, you grant Teal AI a non-exclusive, worldwide, royalty-free license to host, store, process, and transmit your User Content strictly for the limited purposes of: (i) operating the Service and syncing your data across devices and sessions, and (ii) transmitting relevant text snippets to our third-party AI providers solely to answer your interactive queries. Teal AI claims no ownership over your User Content and explicitly will not use your User Content to train our AI models.

5. Acceptable Use

You agree not to use the Service to:

• Upload malicious code, viruses, or malware.
• Attempt to reverse engineer, decompile, or hack the Teal AI application or its underlying AI models.
• Exploit, bypass, or abuse any rate limits or usage restrictions on the platform.
• Engage in any activity that is illegal, abusive, or violates the rights of others.

6. Intellectual Property

a. Teal AI Property: All rights, title, and interest in and to the Service (excluding User Content), including our underlying software, AI algorithms, branding, and original content, are and will remain the exclusive property of Teal AI and its licensors.

b. AI-Generated Output: Subject to your compliance with these Terms, you may use the text generated by the AI in response to your interactions for your personal, non-commercial use.

7. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without notice or liability, for any reason, including if we reasonably believe you have violated these Terms or repeatedly uploaded copyright-infringing material.

8. Disclaimers

The Service is provided on an "as is" and "as available" basis. Teal AI makes no warranties, express or implied, regarding the accuracy, reliability, or availability of the Service or the AI-generated responses. We do not warrant that User Content will never be lost or corrupted.

9. Limitation of Liability

To the maximum extent permitted by law, in no event shall Teal AI be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the Service; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; or (c) any User Content or defamatory, offensive, or illegal conduct of any third party.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Delaware, without regard to its conflict of law provisions.

11. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app or website and updating the "Last Updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
